These Terms of Service ("Terms") govern your access to and use of X4 Digital ("Service"), operated by X4 Digital ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you disagree with any part, do not use the Service.
X4 Digital is an AI-powered web design platform that allows users to create, host, and manage professional websites through a conversational chat interface. The Service includes:
To use the Service, you must create an account with a valid email address. You are responsible for:
You must be at least 18 years old or have parental consent to create an account. You may not create accounts on behalf of others without their authorization.
The $1 activation fee grants full Starter-tier access for 30 days. After the trial period, your account automatically continues at the applicable plan rate ($9/mo for Starter) unless you cancel before day 31 or elect to downgrade to the Free tier. You will not be charged beyond the $1 activation fee if you cancel before the trial ends.
Paid subscriptions are billed monthly in advance. Your billing date is set based on your first paid period. Subscriptions auto-renew unless cancelled. You may cancel anytime from your dashboard — cancellation takes effect at the end of the current billing period, and your site remains live until then.
Agency tier is billed at $49/mo base fee plus $9 per active site per month. "Active site" means any site on your account with a published, live URL.
Additional services are available at per-use rates: revision sessions ($5 each), blog posts ($5 each), image regenerations ($2 each). These charges appear on your next billing statement.
Monthly subscription payments are non-refundable once the billing period has started, except as required by applicable law. The $1 activation trial exists as our refund policy — we encourage you to cancel before day 31 if the Service doesn't meet your needs. We do not offer prorated refunds for partial billing periods.
You agree not to use the Service to:
We reserve the right to terminate accounts that violate this policy, with or without notice.
You retain ownership of all content you provide to the Service (business descriptions, uploaded assets, contact information). You grant X4 Digital a limited, non-exclusive license to use this content solely to provide the Service to you.
You own the website files generated for you by the Service, including HTML, CSS, JavaScript, and AI-generated images specific to your site. You may download, modify, host, or transfer these files freely. This license is perpetual and royalty-free.
X4 Digital retains all rights to the AI model, platform software, design system, and technology underlying the Service. Nothing in these Terms transfers ownership of platform IP to you.
The Share & Earn affiliate program pays 20% recurring commission on referred subscriptions. Program participation is subject to these additional terms:
Websites built on X4 Digital are hosted on Cloudflare Pages infrastructure. While we target 99.9% uptime, we do not guarantee uninterrupted service. X4 Digital is not liable for downtime caused by Cloudflare or other third-party infrastructure providers. We reserve the right to take services offline for maintenance, and will provide advance notice where reasonably possible.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to data practices described in the Privacy Policy.
You may close your account at any time from your dashboard or by emailing matt@ubfam.com. Upon termination, your site will remain accessible until the end of your current billing period. After that, your site URL will be deactivated. Downloaded site files remain yours.
We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if your account is involved in illegal activity. We will make reasonable efforts to notify you before termination except where immediate action is required.
After account closure, we retain account data for up to 90 days before deletion, except where required to retain it for legal compliance. You may request data export before closing your account.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR APPROPRIATE FOR ALL PURPOSES. AI-generated content may contain inaccuracies — review all generated content before publishing.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, X4 DIGITAL'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
We may update these Terms from time to time. We'll notify you of material changes via email or a notice within the platform. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. You can always find the current version at x4digital.co/terms.
These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction, as required by applicable law. Nothing in these Terms limits your rights under applicable consumer protection laws.
